Terms of Use

These Terms of Service for Global Supportus. (this "Agreement") is a legal agreement between you (either an individual or an entity that you are representing, hereinafter "you") and Global Supportus and its suppliers and licensors for the Global Supportus Services ("Services"). By using for or purchasing the services or by accepting this agreement you acknowledge that you have read this agreement, that you understand it, that you agree and accept the terms as presented herein. If you do not agree to these terms and conditions, do not apply for, accept, use or purchase the services. The Services include new products, product changes, upgrades, support and other services. You may only receive the Services if you are a Service subscriber in good standing with a valid, account with Global Supportus.The services are for a limited Time only, failure to use the services within the subscription period shall not grounds for a REFUND of ANY FEES PAID

Definitions

Terms defined in these Terms and Conditions are also used in the Privacy Policy and are incorporated by reference to these Terms and Conditions.

"Content"

Software, Materials, Services and other related information are collectively referred to as "Content."

"You" or "you"

"You" means you individually, any person, including any employer that you are acting on behalf of

"Services"

"Services" means Global Supportus Support Services, which are Global Supportus chat and phone based computer optimization and PC cleaning services as set forth on the Global Supportus web site. The Services include virus diagnosis, virus removal, PC tune-up, Internet login protection, software installation, printed setup, printer support, and general computer trouble shooting services. The scope of the services is subject to change without notice, and Global Supportus may discontinue or modify the Services in its sole discretion.

"Software" means any software used by Global Supportus in connection with the Services.

"Subscription Period"

Subscription Period means the time period that Subscriber is eligible to receive the Services. The Subscription Period shall commence on that date the Services are subscribed to and shall terminate after three months or the period specified in the chosen package.

General

Technical Support Services are provided only via phone, Internet chat and remote desktop sharing. Services are provided upon Subscriber's contacting Global Supportus support as explained on the Global Supportus Subscriber authorizes Global Supportus to configure its computers and delete the files that Global Supportus deems unnecessary to a computer's operation. Subscriber gives Global Supportus express permission to alter the registry of any computer receiving the Services as needed to provide the Services. The Services may require additional software. Subscriber gives Global Supportus express permission to install, configure, and use such software on Subscriber's computers.

Access

To provide the Services, Global Supportus must access a computer or network receiving the Services over the Internet. A high speed Internet connection is highly recommended in order to avoid delays or problems with the Services. Subscriber is solely responsible for providing an Internet connection and access to its computers. Subscriber must assist Global Supportus in any manner necessary to diagnose the computer and provide the Services. Failure to fully cooperate with the Global Supportus representative shall be considered a breach of this Agreement. All instructions and steps taken in providing the Services shall be left to the Global Supportus representative's sole discretion. Subscriber warrants that use of the Services complies with all applicable computer and network policies. Prior to receiving the Services, Subscriber must have administrator rights to the computer, have a back-up of all data on the computer, and provide Global Supportus with correct and accurate information.

"Termination of Services"

Global Supportus reserves the right to terminate the Services with proper intimation to You if the company determines that the subscription service You’ve availed is being used by any other person other than You, or on any other system other than the one registered with us. In such a scenario Global Supportus will refund a portion of fees You prepaid while You first availed our Services for the days left until its renewal, on pro-rata basis. However the refund is further subject to additional requirements, restrictions, and limitations of the subscription plan You’ve availed. For more information please refer to our Refund Policy.

"PAYMENT"

Services against any Plan Order will be available once Customer has made payment for Services according to the requirements of the corresponding Plan Order. All payments against the plan orders will be collected by Global Supportuson behalf of Global Supportus. Global Supportushas no obligation to render Services under any Service Plan if the payments as required under any Plan Order have not been made. Customer understand that certain Service Plans may have fee including, but not limited to “Service Fee” and/or “Activation Fee” payable either on an annual basis (“Annual Payment Plan”) or on a monthly basis (“Recurring Payment Plan”). Subject to the applicable Term Plan, all payments under the Annual Plan shall be made upfront at time of commencement of the subscription cycle. For payments under the Recurring Payment Plan, apart from the monthly installments of the Service Fee, payable over a one (1) year payment term, Customer shall be charged an additional non-refundable Activation Fee at the time of registration, as specified in the Plan Order. The fee (including Activation Fee) will not be refunded in case of cancellation of the Service Plan unless otherwise stated in the Plan Order. All fee under this clause or a relevant Plan Order, is payable at the time of commencement of the Service Plan. When Customer purchased the Service, Customer agreed to a specific price and plan, where such plan maybe for a term of one OR two years (“Term Plan”). All terms of Service Fee and/or any other fee payable under any mode of payment for a Subscription shall be set forth in the applicable Plan Order. Similarly, some plans may offer a discount on the Service if Customer sign up for other Global Supportus services (“Bundle Discount”). Customers are agreeing to maintain Customer Service and the bundled services for the applicable term. If Customer signed up for a Term Plan or a Bundle Discount, the price available with those plans is valid until one of the following occurs: (1) the Term Plan expires; (2) Customer drop one of the Global Supportus services Customer were required to purchase to receive the special rate as notified to Global Supportus; or (3) Customer terminate the agreement/Service Plan before the expiry of the relevant term. Credit Card, Debit Card, Internet banking and IVR Billing.

Customer may be asked to provide us with a Credit Card, Debit Card and internet banking details from a card issuer that we accept in order to activate Customer Service. The Customer hereby authorizes Global Supportusto charge and/or place a hold on Customer Credit Card, Debit Card and internet banking details with respect to any unpaid charges for Services or any related equipment. Customer authorize the issuer of the Credit Card, Debit Card, internet banking to pay any amounts described herein without requiring a signed receipt, and Customer agree that these charges are to be accepted as authorization to the issuer of the Credit Card, Debit Card, internet banking to pay any amounts described herein without requiring a signed receipt, and Customer agree that these charges are to be accepted as authorization to the issuer of the Credit Card, Debit Card and internet banking details to pay all such amounts. Customer authorize Global Supportus and/or any other company who bills products or services, or acts as billing agent for Global Supportusto continue to attempt to charge and/or place holds with respect to all sums described herein, or any portion thereof, to Customer Credit Card, Debit Card and internet banking until such amounts are paid in full. Customer agree to provide Global Supportuswith updated Credit Card, Debit Card, internet banking information upon Global Supportus's request and any time the information Customer previously provided is no longer valid. Customer acknowledge and agree that neither Global Supportus nor any Global Supportus affiliated company will have any liability whatsoever for any non-sufficient funds or other charges incurred by Customer as a result of such attempts to charge, and/or place holds on, Customer Credit Card, Debit Card and internet banking. If Customer mistakenly provide any card number, instead of a Credit Card, Debit Card, internet banking number, Customer authorize all charges described herein to be applied to such card unless and until Customer provide a Credit Card, Debit Card, internet banking number. In the event Customer are enrolled, or later enroll, in an automatic payment or electronic funds transfer plan, Customer agree that all sums described herein may be charged, at Global Supportus’s option, to the account number provided for such automatic payment or electronic funds transfer plan. When payment is made by Credit Card, Debit Card, internet banking, payment will also be subject to the terms and conditions established by the credit or debit card issuer.

REFUND POLICY

For subscription plans, a full refund will be issued if Global Supportus has not been able to resolve even a single issue for your computer within the first 30 days of the signing up to Global Supportus subscription.

If our technical support has resolved one or more issues, the fees charged for subscription service will not be refunded. Its sole discretion of Global Supportus and on a case by case basis, refund can be issued of the charged fees after deducting charges for services provided to customer

For incident plans, you will be eligible for refund when any of the following criterions are met:

  • The issue is out of scope for the particular plan
  • 30 days have not passed after the issue was last worked upon by a Global Supportus technician

"Disclaimers & Limitation Of Liability"

1:Global Supportus does not represent or warrant that the Services will be uninterrupted or error free, that defects will be corrected, or that the service or the server(s) that makes them available are free of viruses or any other harmful components. Global Supportus does not represent that the use or the results of the use of the Services or the materials made available as part of the Services will be correct, accurate, timely or otherwise reliable.

2:Global Supportus is not responsible or liable for conduct of any other party or any infringement of another’s rights including intellectual property rights.

3:Global Supportus and its respective third party suppliers make no representations about the suitability, reliability, availability, timeliness and accuracy of the Services for any purpose. You agree that the Services are provided as is without warranty of any kind. Global Supportus and its representative suppliers hereby disclaim all warranties and conditions with regard to the Services, including all implied warranties and conditions of merchantability, fitness for a particular purpose, compatibility of computer systems, title, non-infringement, or arising out of any statutes.

4: Global Supportus reserves the right to update and change, from time to time, this Agreement, and post the new version of this Agreement on it’s website at www.globalsupportus.com, without notice to you. Any request for the services(s) after a new version of this Agreement has been posted will be deemed as your acceptance of the changes to this Agreement.

5:In no event will Global Supportus or it’s third party suppliers be liable for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever including, without limitation, damages for loss of use, data or profits arising out of or any way connected with: the use or performance of the Services; the delay or the inability to use the Services; any information, software products, services or related graphics obtained through the Services; whether based on contract, tort, negligence, strict liability or otherwise, even if Global Supportus or any of it’s third party suppliers have been advised of the possibility of damages. If you are dissatisfied with any portion of the Services or any of these terms of use your sole and exclusive remedy is to discontinue using the Services.

"Renewal Policy"

By providing Global Supportus the credit card details and the permission to charge Your credit card, You are agreeing that the Subscription under the Recurring Payment Plan will automatically get renewed for a month unless You inform Global Supportus otherwise. However, this is not applicable to the Subscription plan under the Annual Payment Plan, which will get automatically expired at the end of the applicable Term Plan. Global Supportus will charge the prevailing subscription rates as per the payment option that You chose at the registration time.
